1. AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and KRISHI PATHSHALA (“Company”, “we”, “us”, or “our”), concerning your access to and use of the https://krishipathshala.in/ website, as well as any other media form, channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

By accessing the Site, you agree that you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last updated” date, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms to stay informed of updates. Your continued use of the Site represents your acceptance of any revised Terms.

The Site is intended for users who are at least 13 years of age. Minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Site.

2. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property. Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use.

3. USER REPRESENTATIONS

We reserve the right to remove, reclaim, or change a username you select if we determine it is inappropriate, obscene, or otherwise objectionable.

• Attempt to bypass any measures of the Site designed to restrict access.
• Copy or adapt the Site’s software (including Flash, PHP, HTML, JavaScript, etc.).
• Decipher, decompile, disassemble, or reverse engineer any software comprising the Site.
• Use any unauthorized automated system, spider, robot, or scraper to access the Site (except for standard search engine usage).
• Use a buying or purchasing agent to make purchases on the Site.
• Make unauthorized use of the Site, including collecting email addresses for unsolicited communications or creating accounts under false pretenses.
• Use the Site to compete with us or for any commercial, revenue-generating enterprise.

6. USER GENERATED CONTRIBUTIONS

The Site may invite you to participate in blogs, message boards, online forums, and provide opportunities to submit, post, or publish content (collectively, “Contributions”). Contributions may be viewable by other users and third-party websites. Therefore, any Contributions you transmit may be treated as non-confidential and non-proprietary.

When you create or make available any Contributions, you warrant that:

• The creation, distribution, and display of your Contributions will not infringe the proprietary rights (copyright, trademark, patent, etc.) of any third party.
• You are the creator and owner of, or have the necessary licenses and consents to use, your Contributions.
• You have the written consent of every identifiable person in your Contributions to use their name or likeness.
• Your Contributions are not false, inaccurate, or misleading.
• Your Contributions are not unsolicited advertising, spam, or pyramid schemes.
• Your Contributions are not obscene, violent, harassing, libelous, or otherwise objectionable.
• Your Contributions do not ridicule, mock, disparage, or abuse anyone.
• Your Contributions do not advocate violent overthrow of governments or physical harm.
• Your Contributions do not violate any applicable law or regulation, including privacy or publicity rights.
• Your Contributions do not exploit minors or solicit personal information from anyone under 18.
• Your Contributions do not include offensive comments connected to race, national origin, gender, sexual preference, or physical handicap.

7. CONTRIBUTION LICENSE

By posting your Contributions, you automatically grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, worldwide license to host, use, copy, reproduce, disclose, sell, publish, broadcast, and distribute your Contributions for any purpose (commercial or otherwise), and to prepare derivative works.

We do not assert ownership over your Contributions. You retain full ownership, and you expressly agree to exonerate us from any responsibility or legal action regarding your Contributions. We reserve the right to edit, re-categorize, or delete any Contributions at our sole discretion, without notice.

8. GUIDELINES FOR REVIEWS

When posting a review on the Site, you must comply with the following criteria:

• You should have firsthand experience with the subject being reviewed.
• Reviews must not contain offensive profanity, abusive, racist, or hate language.
• Reviews must not contain discriminatory references based on religion, race, gender, national origin, age, sexual orientation, or disability.
• Reviews must not reference illegal activity.
• You must not be affiliated with competitors if posting negative reviews.
• You may not post false or misleading statements.
• You may not organize campaigns to manipulate reviews.

We may accept, reject, or remove reviews at our sole discretion. We assume no liability for any review or resulting claims. By posting a review, you grant us a perpetual, worldwide, royalty-free license to reproduce and distribute the review content.

9. SOCIAL MEDIA

You may link your Site account with third-party service providers (a “Third-Party Account”). By doing so, you represent that you are entitled to grant us access to your Third-Party Account without breaching their terms. We may access, make available, and store any content from your Third-Party Account (“Social Network Content”) so it is available on the Site. You can deactivate this connection at any time through your account settings. We are not responsible for any Social Network Content.

10. SUBMISSIONS

Any questions, comments, suggestions, ideas, or feedback regarding the Site (“Submissions”) provided by you are non-confidential and shall become our sole property. We own exclusive rights to use and disseminate these Submissions for any lawful purpose without acknowledgment or compensation to you.

11. THIRD-PARTY WEBSITES AND CONTENT

The Site may contain links to other websites (“Third-Party Websites”) and content belonging to third parties (“Third-Party Content”). We do not monitor or check these for accuracy, appropriateness, or completeness. We are not responsible for any Third-Party Websites or Content. Inclusion of a link does not imply our endorsement. Accessing Third-Party Websites is done at your own risk.

12. ADVERTISERS

We may allow advertisers to display advertisements in certain areas of the Site. Advertisers take full responsibility for any advertisements placed and services/products sold through them. We simply provide the space and have no other relationship with advertisers.

13. SITE MANAGEMENT

We reserve the right, but not the obligation, to:

• Monitor the Site for violations of these Terms.
• Take legal action against anyone who violates the law or these Terms.
• Refuse, restrict access to, or disable your Contributions.
• Remove files that are excessive in size or burdensome to our systems.
• Manage the Site to protect our rights and property and ensure proper functioning.

14. PRIVACY POLICY

The Site is hosted in India, and by continuing to use the Site from other regions, you consent to the transfer and processing of your data in India.

15. COURSE POLICIES

• Digital Delivery Only: All courses provided by KRISHI PATHSHALA are strictly online. Course access is granted exclusively through our official website or the upcoming Krishipathshala Learners’ App. We do not provide physical hard copies of study materials, nor do we conduct offline coaching classes.
• Unauthorized Representation: Any person or organization offering physical/offline classes under the KRISHI PATHSHALA brand is engaging in deceptive practices. We reserve all legal rights to seek action and compensation against such intellectual property infringement.
• Material Usage: Digital study materials may be downloaded by subscribed users solely for personal use. They must not be distributed, copied, or shared outside the account interface in violation of our Privacy and IPR policies.
• Browser Requirements: Users are advised to access our resources via secure, verified browsers or our official app. We strongly advise against using unapproved, third-party browsers that compromise privacy standards.
• Subscription Duration: All course subscriptions are valid for one (1) academic session. This duration does not strictly correlate to a 365-day calendar year. The date of purchase does not delay or extend the end date of the subscription, which terminates concurrently with the conclusion of that specific academic session.
• Extensions: Users cannot claim an extension if an academic session concludes shortly after their purchase. However, appeals for extensions under exceptional circumstances may be evaluated at our sole discretion. KRISHI PATHSHALA retains full authority over course subscription timelines.

16. SELLING AND REFUND POLICY

Thank you for choosing KRISHI PATHSHALA. All products sold on our platform are exclusively digital (e-versions). No physical products are shipped.

Refund and Cancellation Limitations

Once an order is placed and processed, it cannot be canceled under any circumstances. You are not entitled to cancel your order simply due to a change of mind.

Your Review Rights

If you are unsatisfied with your purchase, you may submit a review or grievance within 72 hours (3 days) of your transaction. Please send a clear statement outlining your concerns to krishipathshala2@gmail.com. We will review and respond to your communication within 7 days of receipt.

Conditions for Refunds

Because standard cancellations are not permitted, refunds are strictly limited to the following technical scenarios:

• Accidental duplicate purchases of the exact same item.
• Multiple payments processed for the same single order due to server errors.
• Purchasing a standalone item that was already included in a bundle or package you previously purchased (in this instance, the refund will apply to the item with the lower monetary value).

To request a refund under these specific conditions, you must submit a clear statement and proof of purchase to krishipathshala2@gmail.com. We reserve the right to refuse a refund if the request does not meet the above criteria. Furthermore, we are not liable for delays or lost funds resulting from bank server failures during the refund process.

17. COPYRIGHT INFRINGEMENTS

If you believe that any material on the Site infringes upon any copyright you own or control, please immediately notify us. Be advised that you may be held liable for damages if you make material misrepresentations in a Notification.

18. TERM AND TERMINATION

These Terms shall remain in full force and effect while you use the Site. We reserve the right, in our sole discretion and without notice, to deny access to the Site, terminate your account, or delete your content for any reason, including breach of these Terms. If we terminate your account, you are prohibited from creating a new account under your name or a fake name.

19. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Site at any time without notice. We will not be liable for any modification, price change, suspension, or discontinuance of the Site. We cannot guarantee the Site will be available at all times and assume no liability for downtime, interruptions, or errors.

20. GOVERNING LAW

These Terms shall be governed by and defined following the laws of India. KRISHI PATHSHALA and you irrevocably consent that the courts of India shall have exclusive jurisdiction to resolve any dispute arising in connection with these terms.

21. DISPUTE RESOLUTION

• Informal Negotiations: The Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration.
• Binding Arbitration: Any dispute shall be referred to and finally resolved by the International Commercial Arbitration Court under the European Arbitration Chamber. The seat of arbitration shall be Bankura, India. The language of proceedings shall be English.
• Restrictions: Arbitration shall be limited to the Dispute between the Parties individually. No arbitration shall be joined with any other proceeding or arbitrated on a class-action basis.
• Exceptions: Disputes concerning intellectual property rights, allegations of theft/piracy, or claims for injunctive relief are not subject to informal negotiations and arbitration.

22. CORRECTIONS

There may be information on the Site that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and update information at any time, without prior notice.

23. DISCLAIMER

THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE ASSUME NO LIABILITY FOR ERRORS, MISTAKES, PERSONAL INJURY, PROPERTY DAMAGE, UNAUTHORIZED SERVER ACCESS, VIRUSES, OR LOSS/DAMAGE INCURRED AS A RESULT OF YOUR USE OF THE SITE.

24. LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE, OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT OR LOSS OF DATA. OUR MAXIMUM LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE ONE (1) MONTH PERIOD PRIOR TO THE CAUSE OF ACTION ARISING.

25. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, claim, or demand (including reasonable attorneys’ fees) made by any third party due to or arising out of: (1) your Contributions; (2) use of the Site; (3) breach of these Terms; (4) breach of your representations and warranties; or (5) your violation of the rights of a third party.

26. USER DATA

You are solely responsible for all data that you transmit to the Site. We shall have no liability to you for any loss or corruption of such data, and you waive any right of action against us arising from such loss.

27. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Visiting the Site, sending emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements and notices satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, AND DELIVERIES.

28. MISCELLANEOUS

These Terms of Use constitute the entire agreement between you and us. Our failure to enforce any right or provision shall not operate as a waiver. If any provision is determined to be unlawful, void, or unenforceable, it is deemed severable and does not affect the remaining provisions. There is no joint venture, partnership, or employment relationship created between you and us. You waive any defenses based on the electronic form of these Terms.
